Terms for courses, exams, and translations.

The German version of these Terms & Conditions is legally binding. This English translation is provided for convenience only.

§1 Scope

These Terms & Conditions apply to all contracts between Sprachzentrum Dialog e.U. and its customers for German courses, ÖSD/ÖIF exam registrations, and translation services — with both consumers and businesses.

§2 Registration & contract formation

Registration takes place online via the booking/contact form or in person on-site. The contract is formed once Sprachzentrum Dialog e.U. sends written confirmation (by email).

§3 Prices & payment

Prices stated include statutory VAT where applicable. Payment is made by bank transfer within 14 days of the invoice date. Every invoice includes an EPC QR code (“scan-to-pay”/“Zahlen mit Code”) for convenient payment via your banking app.

§4 Statutory right of withdrawal for consumers (distance contracts)

(1) Consumers who book a course or exam place online have the right to withdraw from this contract within 14 days without giving any reason (§11 FAGG). The period starts on the day the contract is concluded, i.e. the day of our written registration confirmation. Details and the model withdrawal form are in our withdrawal notice.

(2) These Terms & Conditions can neither shorten nor exclude that statutory right. In particular, it does not end early merely because the course or exam date falls within the withdrawal period or has already begun.

(3) Early start of performance: if the course starts, or the exam takes place, while the 14-day withdrawal period is still running, we begin providing the service before that period expires only if you expressly request it when registering and, at the same time, confirm that you have taken note that you lose your right of withdrawal upon full performance of the contract (§10 FAGG). We obtain both declarations separately in the registration form.

(4) If you then withdraw within the withdrawal period, you must pay us an amount which, measured against the total agreed price, corresponds to the services already provided up to the moment your withdrawal reaches us (§16(1) FAGG). No other costs or cancellation fees arise from a withdrawal within that period (§16(4) FAGG).

(5) The cancellation rules in §5 and §6 apply in addition and independently. Where both are available to you, you may rely on whichever is more favourable.

§5 Cancelling courses

  • Free cancellation up to 14 days before the course start.
  • A €30 administration fee applies for cancellations less than 14 days before the course start.
  • From the course start date, the full course fee is due.
  • Missed sessions are not refunded.

§6 Cancelling exam registrations

  • Free cancellation up to 14 days before the exam date.
  • 50% of the exam fee is due for cancellations 8–13 days before the exam date.
  • The full exam fee is due for cancellations 7 days or less before the exam date, or in case of no-show.
  • The applicable ÖSD or ÖIF registration terms apply in addition.

§7 Course cancellation by us

If we cancel a course because the minimum number of participants was not reached, or for any other reason within our responsibility, any payments already made are refunded in full.

§8 Substitute dates / substitute instructor

If a session or an instructor is unavailable, we will make reasonable efforts to provide a prompt substitute (a substitute date or instructor). There is no entitlement to a specific instructor.

§9 Translations

Translation orders are based on an individual quote (Kostenvoranschlag). The delivery date is agreed when the order is placed. If, at your explicit request, we begin the translation before the withdrawal period expires, the early-performance provisions of §10/§16 FAGG apply (see our withdrawal notice) — once the service has been fully performed, the right of withdrawal expires.

§10 Liability

We are liable without limitation for intent and gross negligence, and for damages arising from injury to life, body, or health. Any further limitation or exclusion of liability applies only within the legally permitted scope (§6 KSchG, Austrian Consumer Protection Act) — these terms do not contain any clause excluding liability for personal injury or gross negligence.

§12 Governing law, jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For contracts with consumers, the mandatory consumer-forum protections of §14 KSchG remain unaffected — these terms do not restrict the statutory consumer forum.

To be confirmed by a lawyer before go-live§4 (statutory right of withdrawal, early start of performance, proportionate payment) was drafted from publicly available sources and is not legal advice. That section, and the wording of the two declarations in the registration form, must be confirmed by an Austrian lawyer before go-live. Also still open, and for the owner to decide together with that lawyer: an offset clause for expenses saved or places re-filled (§1168 ABGB) in §5 and §6.
