Right of Withdrawal

Right of withdrawal

Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason (§11 FAGG, Austrian Distance and Off-Premises Contracts Act). The withdrawal period is 14 days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (Sprachzentrum Dialog e.U., contact details below) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, although it is not mandatory.

Early start of performance and proportionate payment

If your course starts, or your exam takes place, while the 14-day withdrawal period is still running, we begin providing the service before that period expires only if you expressly request it when registering and, at the same time, confirm that you have taken note that you lose your right of withdrawal upon full performance of the contract (§10 FAGG). We obtain both declarations separately in the registration form; without them we start only after the period has expired.

If you withdraw within the withdrawal period after making such a request, you must pay us an amount which, measured against the total agreed price, corresponds to the services already provided up to the moment your withdrawal reaches us (§16(1) FAGG). No other costs or cancellation fees arise from a withdrawal within that period (§16(4) FAGG).

Your statutory right of withdrawal does not end merely because the course or exam date falls within the withdrawal period or has already begun. The period starts on the day the contract is concluded, i.e. the day of our written registration confirmation. The contractual cancellation rules in our Terms & Conditions apply in addition and independently; where both are available to you, you may rely on whichever is more favourable.

Exceptions to the right of withdrawal

For courses and exams with a fixed, agreed date, the right of withdrawal may be excluded under §18(1) no. 10 FAGG (services related to leisure activities provided on a specific date). Because this exception can be disputable in individual cases — for example when an exam (such as an ÖIF integration exam) is taken for professional or official purposes — we grant the full statutory right of withdrawal wherever it applies, as a matter of legal certainty, and transparently note the possible exception here.

For translation services that have already been fully performed, the right of withdrawal expires under §18(1) no. 1 FAGG once performance has begun with your explicit consent and you have acknowledged that you lose your right of withdrawal upon full performance of the contract (§10, §16 FAGG).

Effects of withdrawal

If you withdraw effectively, we will reimburse all payments received from you without undue delay, and no later than 14 days from the day on which we receive notice of your withdrawal, using the same means of payment you used for the original transaction, unless expressly agreed otherwise.
